WARRANTY & AFTER-SALES SERVICE CLAUSE

For Kitchens, Wardrobes & Joinery Works

This Warranty and After-Sales Service Clause forms an integral part of the Agreement between Tafaseel Kitchens Trading LLC and the Client.

The Company hereby warrants that all kitchens, wardrobes, and joinery works supplied and installed under this Agreement shall be free from defects in materials and workmanship, subject to the terms and conditions stated herein.

1. Warranty Period

1.1 The warranty shall be valid for a period ranging from Five (5) Years up to Twenty-Five (25) Years, depending on the applicable product, material, and manufacturer’s warranty, commencing from the official date of final handover.

1.2 This warranty covers manufacturing defects and workmanship-related faults only.

1.3 The warranty period for accessories, fittings, and appliances shall be governed by the respective manufacturer’s warranty policies.

2. Free Maintenance Service (FMS)

2.1 The Company shall provide Free Maintenance Service (FMS) for a period of One (1) Year from the date of handover.

2.2 FMS includes the following services:

Adjustment and alignment of cabinet doors and panels

Adjustment of hinges and drawer runners

Inspection and minor corrections related to workmanship defects

General functional inspection

2.3 FMS does not include:

Replacement of damaged parts

Replacement of consumables

Repairs resulting from misuse, negligence, or external damage

Works arising from alterations made by third parties

3. Scope of Warranty Coverage

3.1 This warranty applies exclusively to items supplied and installed by the Company, including but not limited to:

Kitchen cabinets and components

Wardrobes and storage systems

Vanities and bathroom cabinets

Decorative and functional joinery works

All items agreed under the signed contract and approved drawings

3.2 All materials, accessories, hardware, and fittings shall be covered in accordance with the respective manufacturer’s warranty terms.

3.3 Any item supplied by the Client or third parties shall be excluded from this warranty.

4. Warranty Exclusions

This warranty does not cover, including but not limited to, the following circumstances:

4.1 Misuse and Negligence

Excessive loading beyond design limits

Improper handling, impact, or rough use

Use of harsh chemicals, abrasive cleaners, or unsuitable cleaning agents

4.2 Improper Maintenance

Failure to follow the Company’s care and maintenance guidelines

Lack of proper ventilation in kitchen and wardrobe areas

4.3 Normal Wear and Tear

Natural fading, discoloration, or aging of surfaces

Minor scratches and cosmetic changes

Natural expansion or contraction of wood-based materials

4.4 External and Accidental Damage

Scratches, dents, burns, cracks, or water damage

Damage caused by third parties, contractors, or visitors

4.5 Environmental and Site Conditions

High humidity, heat, moisture, or direct sunlight exposure

Plumbing leakage, seepage, or condensation

Pest infestation

4.6 Force Majeure

Fire, flood, storm, earthquake, war, riot, or acts of God

4.7 Unauthorized Works

Modifications, dismantling, or repairs by unauthorized parties

Installation of additional equipment without Company approval

4.8 Utility-Related Issues

Electrical, plumbing, gas, or appliance-related failures not caused by joinery defects

5. Warranty Claim Procedure

5.1 All warranty claims must be submitted in writing by the Client via official email or registered communication.

5.2 Claims must include:

Client name and contact details

Project reference number

Proof of handover date

Description and photographs of the defect

5.3 The Company shall inspect the reported defect within a reasonable period and determine the appropriate corrective action.

5.4 The Company reserves the right to reject any claim found to be outside the warranty scope.

6. Company Obligations

6.1 Upon confirmation of a valid warranty claim, the Company shall, at its sole discretion:

Repair the defective item, or

Replace the defective item with an equivalent product, or

Provide an alternative technical solution

6.2 Replaced or repaired items shall be covered only for the remaining original warranty period.

6.3 The Company shall not be liable for any indirect, incidental, or consequential damages, including loss of use, business interruption, or alternative accommodation costs.

7. Client Obligations

The Client shall:

Use all installed items in a proper and reasonable manner

Follow recommended care and maintenance instructions

Provide reasonable access for inspection and repair works

Notify the Company promptly upon discovering any defect

Failure to comply with the above may result in warranty voidance.

8. Limitation of Liability

8.1 The Company’s maximum liability under this warranty shall not exceed the original contract value of the affected item.

8.2 Under no circumstances shall the Company be liable for consequential, special, or indirect losses.

9. Validity and Transferability

9.1 This warranty is valid only for the original Client and original installation location.

9.2 The warranty is non-transferable unless expressly approved in writing by the Company.

9.3 Relocation, dismantling, or reinstallation by any party other than the Company shall immediately void the warranty.

10. Governing Law and Jurisdiction

This Warranty Clause shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Any disputes arising herefrom shall be subject to the exclusive jurisdiction of the competent courts of the UAE.

11. Acceptance

By signing this Agreement, the Client acknowledges that he/she has read, understood, and accepted the terms and conditions of this Warranty and After-Sales Service Clause.
